AB 747 And Reasonable Diligence
California’s AB 747, the Service of Process Accountability, Reform and Equity Act, concerns service procedures and accountability. It should be read with its operative dates and any later amendments. An older summary is not a substitute for the current law applicable to an assignment.
Check The Provision And Its Start Date
The official AB 747 bill record identifies the enacted text. A June 2026 Senate Judiciary analysis of AB 2042 discusses clarifying changes to provisions scheduled for January 1, 2027. Confirm the final applicable text and any later changes with counsel.
Documentation Still Matters
Record accurate dates, times, locations, and outcomes. Give the server reliable address information and the complete packet. If an address cannot be confirmed, discuss the available information and any authorized research before ordering additional work.
Avoid Blanket Claims
Do not assume every case has the same attempt requirement or that paid skip tracing is mandatory for every assignment. The document, procedure, operative law, and any court order control. A fixed attempt count alone does not establish every requirement for alternative service.
Prepare For The Specific Assignment
- Identify the document and court.
- Provide complete names, addresses, and known scheduling information.
- Include any deadline or order affecting service.
- Confirm required proof and supporting documentation.
- Obtain legal direction before requesting an alternative method.
