California Judgment Collection Laws You Should Know

California Judgment Collection: Check Current Rules

Winning a money judgment does not automatically produce payment. Collection depends on the judgment, the available assets, and the procedure used. An older summary of code sections should not be treated as a complete collection plan.

Verify The Judgment And Next Step

Check the court record, amount still due, and any stay or other restriction before proceeding. Use the California Courts collection guide to identify official instructions. A lawyer or court self-help center can explain which process may fit the case.

Do Not Assume A Single Interest Rate

Interest and renewal rules can depend on the judgment and applicable law. Do not calculate every judgment using an old blanket statement that all balances accrue ten percent interest. Confirm the correct basis and keep a dated calculation with your records.

Different Remedies Require Different Papers

Bank levies, wage withholding, debtor examinations, and recorded liens are not interchangeable. Forms, service requirements, exemptions, and fees differ. Obtain current instructions for the particular remedy rather than combining steps from several procedures.

Confirm Bank Service Locations

If the assignment involves a financial institution, check the DFPI service-location directory and the levying officer’s instructions. A familiar local branch may not be the designated location.

Keep A Clear Record

Retain the issued papers, written instructions, proof of service, payment records, and any return from the levying officer. Service of papers does not guarantee funds or resolve an exemption dispute.
