Orange County Divorce Process, Part 1: Starting The Case

This first part of our series focuses on getting ready to file and arrange service. Divorce requirements depend on the case. Use current forms and court instructions rather than a checklist saved from an older article.

Confirm The Filing Requirements

Start with the California Courts divorce guide and your local court’s family-law resources. Residency, jurisdiction, and eligibility for a simplified procedure should be confirmed before filing. Summary dissolution has several requirements; a short marriage alone does not establish eligibility.

Prepare And File The Required Papers

Your attorney or self-help center can help identify the proper forms. Check names, addresses, case information, required attachments, and the current filing fee or fee-waiver procedure. Keep copies of what the court issues.

Arrange Initial Service

The next step is formal delivery of the required packet. You cannot serve your own initial papers. Give an eligible server complete documents, a reliable address, and any service instructions. The official service guide explains available methods and proof of service.

A Waiting Period Is Not A Final Judgment

California’s minimum waiting period does not mean a divorce automatically ends after six months. Required paperwork and a court judgment are still necessary. Ask the court or your attorney about the date and steps that apply to your case.

Continue to Part 2: response, disclosures, and decisions or Part 3: completing the case.
