Things To Consider About Orange County Bank Levies

Before Arranging An Orange County Bank Levy

A bank levy can sometimes help collect a judgment, but it does not guarantee a full or immediate payment. Check the documents, location, costs, and available information before ordering service.

Confirm The Institution And Debtor Details

Use the debtor’s correct legal name and reliable information. Do not rely on a guess that the debtor probably banks at a large institution. Ask your attorney about lawful ways to obtain account information and the paperwork needed for your case.

Use Current Forms And Instructions

Check the issued writ and the responsible sheriff’s levy instructions. The California Courts bank levy guide explains the basic process. Court and sheriff fees change, so obtain a current total rather than using an old article’s $25 estimate.

Verify The Correct Bank Office

Check the institution’s current designation in the DFPI directory. Do not assume every branch accepts the documents. Give your server the designation and any relevant instructions.

Allow For Exemptions And Processing

Some funds are protected, and a debtor may claim an exemption. A dispute is determined through the applicable legal process. Do not assume an objection is invalid or that the court will rule for the creditor.

A levy is not a continuous hold on every future deposit. Avoid planning around a promised payout date or a generic day-of-month tactic. Ask the levying officer about its current processing and return procedures.
