California Eviction Rules: Use Current Instructions

This article originally discussed AB 2343 and changes that took effect in 2019. That announcement is historical. Its old summons and five-day response language should not be used as instructions for a current unlawful detainer case.

What To Check Today

Get the current summons and statewide forms from California Courts, then check the filing court’s local requirements. The notice used before filing and the time to respond after service are different issues. Both can depend on the facts and applicable rules.

For a current lawsuit, use the official response guide and landlord after-service guide. Ask an attorney or court self-help center to confirm the deadline and how it is counted for the method of service.

Do Not Reuse An Old Service Packet

Check the form revision date, recipient names, property address, required attachments, and any court order before sending documents for service. An old saved PDF is not evidence that a form is still current.

JPL’s Role
